ANTITRUST STATEMENT

As participants in this meeting, we need to be mindful of the constraints of antitrust laws. There shall be no discussions of agreements or concerted actions that may restrain competition. This prohibition includes the exchange of information concerning individual prices, rates, coverages, market practices, claims settlement practices, or any other competitive aspect of an individual company’s operation. Each participant is obligated to speak up immediately for the purpose of preventing any discussion falling outside these bounds.

    • The move to deprecate the ROE code was because the Architecture Committee and the Executive Committee’s decided that we should not use Trademarked codes in the CIECA Code list, and ROE did not follow the standards structures that are in place for adding codes. For Example, the first letter for a Part starts with 'P'.

  • Recycled Parts and Inventory Committee Concerns

    • ROE was initiated by ARA to help identify parts as Recycled OE, which is different than the Like Kind and Quality parts. With this, ARA trademarked the code.

    • LKQ used to be an ARA term, but then a company came along and named themselves LKQ and they trademarked LKQ.

    • Recyclers wants a code that has a smooth translation and easily identify a part as a Recycled OE part. This is in line with the work that was done before to identify recycled parts.

    • ARA trademarked ROE to get away from using the LKQ code, which was used widely, but now seems to make people think of a Company and not a part type.

  • Problem and Solution

    • PAL is the CIECA code that is in place for Like Kind and Quality, at this time, CIECA does not have a code LKQ. The Description does have LKQ in the mentioned, but the code itself is PAL.

    • The problem with LKQ is it is an ambiguous code, it could mean any recycled part and is not defined in the industry. So when the Machine/CIECA code of PAL enters and application, the application changes the code to show Recycled, but simply recycled.

      • This goes back to LKQ being an EMS standard and CIECA coming up with PAL to represent this part.

    • In an effort to better define a represent parts, the CIECA Architecture committee suggested a NEW PRCY code to be used for Recycled parts when the recycled part has no distinction whether the part being recycled is OEM, AM, or reman.

    • The NEW PRO code would be used to identify Recycled Original Equipment.

    • The machine to machine code would be the CIECA codes of PRCY and PRO

      • When an application receives a PRCY code, it can display to the user, Recycled.

      • When an application receives a PRO code, it can display to the user, ROE.

        • This would mean that ARA would have to give these applications the authorization/License to these companies to use the code ROE.

    • Jeff and Sandy are going to work together to come up with the contacts that ARA needs to discuss the use of ROE in the Estimating and Part Systems.
